Nepalese Law Resources
Here, I have posted some of the links from where we can access legal materials relating to Nepal. This will be a short post giving you some of the links of websites from where you can access information online. We hope that these links come to very handy to anyone who wants to do some research on Nepalese Law and its status and updates.
The first site that you can go through is Website of Nepal Bar Association. http://www.nepalbar.org/member.html is the link which gives you access to the Nepal Bar Council Website and its membership details. Sadly, the membership information page looks like it has been created for the sake of it.
http://www.nepalbar.org/enroll.html is a page in Nepal bar Council where it gives the information on Requirements to enroll as a lawyer. http://www.nepalbar.org/foreign.html is a link which gives you information whether foreign lawyers can practice in Nepal. The information says that Practice by foreign attorneys requires the permission of the Supreme Court of Nepal. For foreigner attorneys no permanent permission could be granted. They could be authorized to argue on case to case basis. I think that after Service sector is fully liberalised in Nepal, Nepal Bar Council removes this restriction.
http://www.nepalbar.org/nepalbar.html is another page which gives introduction about Nepal Bar Council. This page tells you what is Nepal Bar Council, What is does, when it got established etc etc.
You can also access Nepal Bar Council Page in Nepali from http://www.nepalbar.org/councilhome1.html. These are all the pages that are related to Nepal Bar Council. Finally, if you are appearing for Examination to enroll yourself in Nepalese Bar, You can access this page http://www.nepalbar.org/barexam.html . I am not sure whether this page is updated and the course content is a latest one. I have no access to confirm it. But, you can take email id of Nepal Bar Council and mail to them from their page.
After going through Nepal Bar Council Webpage, I find that the website looks in a very nascent stage. The pages can be made more informative and can be updated more frequently. I feel that the pages can be couched with more information to make it more useful for lawyers, students and legal researchers.
Now, great Nepalese Legal site is website of Law Commission of Nepal. You can access the Law Commission of Nepal website from http://www.lawcommission.gov.np/ . It has very great resources uploaded here. And contains many information on statues, manual to frame laws etc. For example, you can visit http://www.lawcommission.gov.np/index.php?option=com_rubberdoc&view=category&id=6%3Astatutes-acts-english-translation&Itemid=6&lang=en where you can see statutes and other important documents that have been included in the website of Law Commission Of Nepal. You can click the various links on that website of Law Commission of Nepal and You can find many more information on the Nepalese Law. The Website of Law Commission of Nepal seems to be slowly developing and I am sure in the future, it will be a great place to search information on Nepalese Law.

This Site will be updated again Continuously
I have decided to update this site again and continuously. I had not for a long time updated this one. As name suggests, the target will be to update about legal news from Nepal. I will be searching and compiling legal news as they happen in our Country.
This time when I am updating this blog, I am working the capacity of legal professional and not as a law student which I was when I started this blog. I completed my B.A;L.L.B (Hons.) from NALSAR University of Law, Hyderabad in 2008 May. Now, I want to enroll myself as a lawyer in Nepal Bar Council. Ideally, I should have done this last year itself but I did not get time to go to Nepal because of my job in India. I was taking awhile to settle in my job life in India. This time, I am planning not to miss the chance of enrollment in Nepal Bar Council.
As per Nepalese Bar Council rules, any LLB Graduates can get registered in Bar Council only after passing the written and Oral Interview Examination. Now, I should start studying Nepalese Law as per the syllabus prescribed by Nepal Bar Council. This Blog, I want to develop, as a one stop shop for many many Nepalese Legal Resources. Aayu Drona Sute……..to Kaun Jage? Dashain Ko Subhakamana.
“aayu drona sute” is Sanskrit mantra/hymns that our parents chant when they put Tika on our forehead in Dashain. In our childhood, it used to be sometimes fun for us. We used to joke like ‘Aayu Drona Sute’……….dashain ka bela sabai jana sute, Chor haru jage………That means all people like drona and others have slept, and only the thiefs are roaming around in the night………..it was our interpretation to create some humour.
The actual meaning of ‘Aayu Drona Sute’ means May you have a long life like Son of Drona. The Son of Drona is called Asosthama, which is considered to be one of the Aastha Chiranjivi (Aastha Chiranjivi means those eight people who never die as per Hindu epics). Therefore, when our parents bless us saying ‘Aayu Drona Sute’, that means let my children have long life like Asosthama………that means you never die.
“Aayu drona sute” is in sanskrit and it is a long chant and each words used there signify something great thing about various people. It is basically the blessings given by your near and dear ones who are generally aged in your families and respected by all family members.
When I talk about Dashain, the nine days puja/worship to god and the tenth day Vijaya dashami should be fondly rembered. Dashain is a festival having fifteen days totally.
There are Dashain Kabita written by various great poets in Nepal. These Kabita/poems depict the grandeur of Dashain and enlighten more about Dashain.
In terms of food also, Dashain is something different like what did nepali people eat in dashain matters. It is mostly a non-veg festival unless you eat only vegetarian food. Generally, the non-vegetarian foods are eaten from 8th day of Navaratri, which is called MahaAsthami and that is today. People, as per their tradition, cut goat, buffalo, chicken etc. on this occasion.
My dashain wish can not be fulfilled but I am yearning for going home. I wish that all Nepalese Celebtare Dashain in great mood.
By evening, I wish to post a nepali gazal about Dashain. I hope I can write a one to depict the beauty and majesty of this Festival.

Vijaya Dashami – Dashain – Subhakamana
First of all, I would like to wish a very Happy Vijaya Dashami and Bada Dashain to all my readers who have visited talkingforum.wordpress.com. Dashain is the greatest festival of Nepal and for all Nepalese around the world. This festival is celebrated as a mark of victory of truth over untruthfulness. There are different mythological and religious stories about Dashain and there are different reasons for it for its celebration. Without going in details the reasons behind its celebaration, what can be safely concluded is it is the biggest festival in Nepal and gives the perfect reasons for Nepalese to meet their relatives; to return to country and homes for those who are far from their home.
Last year, I went my home to celebrate Dashain. That was after 5 straight years. But, this year, I again could not go in this Dashain. I may go home only in December this year.
While recalling those good days of Dashain last year and five years before, the blessings given by parents, grand parents with the sanskrit chant of hymns which starts as “aayu drona sute” counts a lot. In Childhood, sometimes, Dashain must have meant money that we used to get from maternal grandparents, but in all essence, the meetings with family members, the blessings by each others and meeting with relatives is just superb that places this festival entirely on a new pedestal.
I wished to write a Dashain Nepali Kabita for this Dashain but because of some other busy schedule, I have not been able to put down anything. Hopefully, Dashain Nepali Kabita, I can write, in some other days within this Dashain.
I am feeling little sad this time not to be in Home. My many friends went home and wished that I could also go. But, the issues of leave. Hope next time, I can fly with them when I go to airport to see off my friend at the airport.
Once again, finally, I wish all of you a happy Vijaya Dashami/Bijaya Dashami and Hope that Durga Maata le Tapai ko Sabai Kalyan Garun. (May ‘Durga Bhawani’ bless you forever and show you the great path in life)

This is a test Post
I maintain many blogs in the web. I am focusing only in one blog these days. The theme of each blog is different but sometimes, I feel that the same blog post can be posted in different blogs depending on its theme and relevance. This blog post is just a test post. I am trying to post a single entry in my four different blogs at a time. For this, I have taken a help of Scribe fire developed by Firefox Mozilla. Let me see how I can do these postings at a time.

A New Post
From Many Days, this blog has not been updated because of many reasons. The main one was because of Constituent Assembly Election in Nepal. My eyes were glued to Internet and hours and hours I spent there updating myself from various websites.
This is a special blog and each and every news do not find place here. A special kind of News-that is news related to law and legal order will be covered. It seems that these days, nothing much is happening in court as well as I am not able to get any new legal story. Parliament is not there and no bill is discussed before New Parliament of CA is convened. Let’s watch that something good happens now onwards. In this blog entry, I have posted a blog related to Nepalese Economy.
Since Communist Party of Nepal (Maoists) have won this time. Their victory is overwhelming and very stunning and surprising. If everything goes well, they will be heading next government. So, there was kind of fear among the investors regarding the Nepalese Economy.
In this news, Comrade Prachanda speaks about what kind of Economy Maoist will push in future.
Stock market has been crashed and business circle is confused. As the news of Maoist victory in the polls come out, the Maoist leadership is trying hard to assure the business community that they are here for capitalism.
For the CPN Maoist, the victorious party in the April 10 CA polls, the campaign hasn’t ended just yet. The party leadership is in full swing to convince the national forces, business world and the international community- at the same time- that they are not radical communist and there will be no cultural revolution in Nepal. Mao has died a long time ago. It seems that the Prachandapath (the path of Prachanda), an ideology propagated by Chairman Prachanda, tells them to have a very good relationship with ‘expansionist’ India and ‘imperialist’ America. Capitalism, they try to convince, is their mantra too. Prachanda says they are for the economy in which capitalists can have profit. Prachanda also says that there will not be a dictatorship of the proletariat. In his address to the business leaders in Kathmandu today the Maoist Chairman announced that the power will not be used tyrannically, reports Kantipur, but in the welfare of the people and the country.
Pointing to the decade-long political revolution and Janaandolan-II as examples of miracles, Maoist supremo Prachanda said an economic revolution is going to be the next miracle. “People will see that as soon as we form the government,” he said. “We will create the buzz of economic reconstruction in every place, every household, and in everyone’s mouth.”
The Maoist Chairman said that his government will adopt the “new transitional economic system” for economic growth stating political development is intertwined with the economy. Pointing to the decade-long political revolution and Janaandolan-II as examples of miracles, Maoist supremo Prachanda said an economic revolution is going to be the next miracle. “People will see that as soon as we form the government,” he said. “We will create the buzz of economic reconstruction in every place, every household, and in everyone’s mouth.”
Prachanda also appealed to the private sector to trust them fully and give them a chance. Elaborating on plans to create a conducive economic environment, he said the government will expand the tax base, eliminate red tape, and end the culture of commissions and corruption. “We will set up an Industrial Security Force in the process of integrating the People’s Liberation Army with the Nepal Army to provide security for industries,” he said.
In response to industrialists’ request to sort out labor disputes, he said they are ready to take necessary and proper steps. “We will welcome foreign investment, and give priority to domestic investment,” he said. Noting that both donors and foreign countries are ready to support the Maoist government, he said he found India ready to take bilateral relations to a new level. “A new ground has been established to make India a part of the cooperation,” he said. He further stressed on new policy for tax system.
In its manifesto for the Constituent Assembly, the former rebels had forwarded a new transitional economic policy with medium level development in the next 10 years, high level growth in 20 years and ultra-high level development in the country in 40 years.
Speaking at the same programme, Maoist second-in-command Dr Babu Ram Bhattarai assured that the government led by the Maoists will move ahead with the Public Private Partnership (PPP) theory.

Contempt of Court: Dristhi Weekly Editor’s Case
I found a news here. It says about the notice of Supreme Court of Nepal to a weekly Newspaper’s Editor. The Editor is alleged to have written a contemptuous Article over a verdict of Supreme Court of Nepal on NRB Governor Case.

Nepal Supreme Court summons Drishti weeklys editor
The Supreme Court (SC) of Nepal has summoned the publisher and editor of Drishti weekly, Shambhu Shrestha, to submit his statement over a news report published in its edition on March 25.
Acting on an application seeking punishment for Shrestha on the charge of contempt of court, Justice Tahir Ali Ansari passed the order after an initial hearing.
According to ekantipur.com, the Nepali weekly, criticised the Supreme Courts March 18 verdict convicting Bijaya Nath Bhattarai, the Governor of the Nepal Rastra Bank and alleged that Justice Ansari had been influenced by financial mafia while passing the judgment.
Shrestha could face imprisonment of up to a year or a fine of up to Rs 10,000 or both, if convicted on the charge of contempt of court on April 4.

These days, I am not much able to track all the news about Legal Development in Nepal. With the coming Election, most of the time, I have kept myself busy in updating recent events related to Election and lack of time has hampered me to update this blog constantly. Though the enthusiasm with which I have started this blog has not disappeared, I must confess that I will not be updating this blog with all the legal news now onwards. What I intend to do nowonwards is to update the blog with most important legal news and instead of copying and pasting news from Various sources, I try to give my views more often which does not mean that I will not be collecting news from various sources.
I will collect many news from various sources which are related to legal development in Nepal but will be bit selective to publish them here. It gives me to do some other works as I am pursuing to work on Constitutional matters related to New going to be Constitution in Nepal and allows me to work on some issues of IPR.
I will elaborate on these issues when time comes and will present you some of my works when they are ready.

Governor Convicted!!!!
Nepalnews reports this recent development here that fomer Nepal Rashtra Bank Governor has been found guilty of financial irregularities by Supreme Court of Nepal and punishment has been imposed on him. We were tracking this news constantly and you can read rest of the stories here. I have no comment on this news as I am not able to read the text of judgments but express my solidarity withdreams of corruption free society. And this is the end of constant following on this corruption case as I have decided to be a bit selective while publishing blog. This issue has been touched in my next entry.
The Supreme Court (SC), Tuesday, decided that governor of Nepal Rastra Bank (NRB) Bijaya Nath Bhattarai and director Surendra Pradhan are guilty of irregularities.
The single bench of judge Tahir Ali Ansari decided that they are guilty of irregularities worth Rs 3.3 million since they did not initiate steps to obtain compensation from a consulting firm after terminating contract with them in a financial sector reforms programme.
The SC decided that the two should be fined the same amount as penalty.
The Commission for Investigation of Abuse of Authority (CIAA) had filed a case against the two for committing irregularities worth around Rs 20 million.
Since the CIAA filed the case against them eight months ago, the two had remained suspended.
Last month, the Special Court had delivered a fractured verdict on the case – with each of the three judges giving different opinions regarding their guilt. Consequently, the case had been referred to the apex court.
